IS THERE ANY RULE OF LAW IN GREAT BRITAIN?

I, ANTOINE ROGER LOKONGO, A CONGOLESE JOURNALIST BASED IN LONDON, DECLARE THAT I HAVE BEEN HELD ILLEGALLY IN CUSTODY AND ON REMAND FOR TWO MONTHS (21.05.2003 – 19.07.2003), FAR BEYOND THE TIME I SHOULD BE KEPT IN THERE BY LAW BY THE BRITISH POLICE AND THE BRITISH JUSTICE SYTEM, WAS SUBSEQUENTLY LET OUT AFTER THE CASE OF HARRASSMENT AGAINST ME WAS DISMISSED (EVEN IF I WAS FOUND GUILTY, ACCORDING TO THE LAW YOU DON’T GO TO PRISON FOR HARASSMENT, YOU DO SOME SORT OF COMMUNITY SERVICE). I CONSULTED SEVEN LAWYERS WHO TOLD ME THAT I HAD NO CASE FOR COMPENSATION AGAINST THE POLICE; THAT I SHOULD JUST BE HAPPY THAT THE CASE WAS DISMISSED AND THEREFORE I HAVE NO CRIMINAL RECORD; THAT THE PERSON I SHOULD SUE IS MY EX-GIRLFRIEND FOR CONCOCTING FALSE ALLEGATIONS AGAINST ME, BUT THAT, THAT WOULD BE A WASTE OF TIME BECAUSE SHE HAS NO MONEY TO COMPENSATE ME. I SHOULD THEREFORE JUST GET ON WITH MY LIFE.

THIS IS WHAT HAPPENED. PLEASE READ ON…

1. I welcomed my ex-girlfriend in my rented council studio flat when she was beaten up by her flat mates in Croydon. She is from Namibia. I have known her since August last year and two of her uncles fought for us in Congo – so she told me - when we were invaded in 1998 by troops from Rwanda, Uganda and Burundi, backed and supported by well known superpowers. The last thing I would have had in my mind is to hurt her.

2. When she left my place (108 Dumbarton Court), she went to live at 118 Dumbarton Court, just next door to me. I accept that when the police were first called in on 27 02.2003, I knocked at 118 Dumbarton Court, asking why Tania or Simone da Souza the Caribbean girl living in that flat and Mark Ellis who was now sleeping with my ex-girlfriend, could put up a stranger that my ex-girlfriend was and whom they did not know at all. Instead they called the police. When the police came, they said they had spoken to my ex-girlfriend and that she is not being held hostage, that she is happy to be there and that I should give her time (…). They said Mark Ellis, the Jamaican guy was not with my ex-girlfriend but with Tania or Simone da Souza. They said if I went there to cause trouble I would be arrested. Point taken. THAT WAS THE WARNING. But then, the next morning, it was my ex-girlfriend who called me AFTER THIS POLICE WARNING and said she wanted us to talk.

“Talk about what?”, I asked her. I told her that some of her stuff were still in my flat and she was either free to come back or free to come and collect them. She chose to come and collect them. IS NOT THAT WANTING TO HAVE THE BEST OF TWO WORLDS?

3. But on 1.03.2003, I saw her stuff literally littered on the corridor of our block. I felt so sad for what has happened and guilty that may be I have put my ex-girlfriend in a very difficult position, accommodation wise; and so I called her at work to ask what was going on. She said she was busy and could not talk. I knew Tania already as a good neighbour. I wrote a letter of apology to her and asked her to help reconcile my ex-girlfriend and myself because I only had her best interests at heart.

4. Shortly after Tania red the letter, the same Mark Ellis together with (Prince?) another Jamaican guy (living at 109 Dumbarton Court, just opposite my door) confronted me on the corridor of the block of council flats where we all live in and warned me that if I sought any contact with either Tania or my ex-girl friend, they would hurt me. That is when I understood the game.

5. Indeed I was physically assaulted subsequently by Mark Ellis, sustaining injuries on my thigh (he kicked me with his boots) when I was just passing. I did not fight back. I called the police who came 5 hours later (Ref. LX 121 6339/03).

ASSAULT IS NOT A CRIME IN GREAT BRITAIN:

A certain PC Wilkinson from Brixton police station actually told me that that would be classified as common assault and it is not an offence in Britain. Therefore the Jamaican man would not be arrested. He can be warned to keep off me that is all. But now, I am charged with the offence of common assault incorporated into harassment.

As a man, I felt very intimidated by Mark Ellis, and let down by the police. I was very angry and felt like a piece of meat. I took my megaphone and stood on the same spot where they nearly attacked me – I DID NOT GO TO THEIR PROPERTY - and summoned the Jamaican guy to a fight. I was ready to fight him. He did not come out. But instead they called the police and they came to arrest me because they said they had warned me not to go 118 Dumbarton Court and knock at the door. If I used the megaphone it is because I wanted people to know what was going on in case I was attacked by the gang that he is part of in Brixton Hill. I explained in vain what had happened to the police and so I refused to follow the two police officers to the station. They called six more police officers and used excessive force, so much so that I hurt my left wrist. One policewoman was pleading with them not to use excessive force. I was arrested by eight police officers on 5.03. 2003, kept in police custody then taken to Camberwell Green Magistrates charged with harassment and released on bail.

6. And now we have a statement from Hilton Hotel where she works as a receptionist which proves that at the when I was arrested, my ex-girlfriend was at work (please, see statement signed by my ex-girlfriend herself enclosed). So how could I have harassed someone “in absentia”? Who called the police on her behalf and why?

7. The police forced her to make a statement after the arrest and because she was not there, the statement was so general that the police rejected it and asked her to make another more “specific” one. And so she had to lie basically.

8. Selma Iyambo even claims that while I was on bail, I followed her on the street one morning shouting abuse at her on my pijamas. That is a complete lie to stain my character. I went jogging every morning. That was the most constructive way for me to deal with the abuse I was subjected to. She also claims that another morning on the bus and on the tube. No. I was not following her, I went early in the morning to Belgian embassy to seek a visa as only 50 passports would be served and the earlier you arrive at the embassy, the better you get a chance to be served.

9. She also claims that while I was on bail, I threatened to kill her and that I put it in writing. I wrote the letter because I was fed up being at the receiving end of a lot of senseless abuse and threats. The main reason why I wrote a letter is because while on bail, I got a call form Croydon from the 59-year old white man complaining that he had not seen Selma (my ex-girlfriend) for weeks and therefore he was worried. I noted the number 0208 668 3504. I told him that Selma was no longer living with me. He replied that he knew where she was living now, that is with «a Jamaican couple». He accused me of having taken his girlfriend away «for some times» from him. He made explicit threats to me, saying he knew he knew where I was living. He told me that I should leave the UK, his country. He confessed that Selma had advertised herself in the local newspaper, and that is how he got to know her; that he found her a job as a receptionist at Hilton Hotel (£5 per hour), opposite Hyde Park; that he had “protected sex” with Selma and gave her £100 per session. If Selma worked late, he would pick her up; that he had always helped African girls in return for sexual gratification; that if Selma is gone for ever, I should find him another African girl; and that one of his neighbour is a policeman. He said I was naïve guy who let himself exploited, thinking that my ex-girlfriend had no money. “How can she not have money,” he exclaimed. “She is a call girl and she works as well.”

I was so shocked and asked myself: WHOM HAD I GONE OUT WITH? I felt so dirty that I wrote a letter to my ex-girlfriend explaining my utter disgust, instead of the letter of reconciliation, I previously wrote to Tania her “new landlady”.

10. The same Tania knocked at my door while I was on bail, dressed in a sexually explicit manner, holding my photo that my ex-girlfriend still kept. She said. “Selma is now with a Jamaican guy. You must therefore leave her alone. She sends you this photograph, so that you may understand that she is for a complete break.” “Save your words for the court,” I replied and closed my door. I reported all these incidents to police. PC Dickson (LX 583) took my report and asked me for my mobile phone number so he can call me and tell me the reference later on. I found a message which read: the reference is 5115 period. Strange enough, my then solicitor, Robert Rye told me not to mention the man in Croydon because he can make life a hell for me! Because I changed solicitors once, the court refused that I change solicitors again because I was on legal aid.

11. I was re-arrested and kept in custody for two months in Brixton Prison. Selma Iyambo claims that on 21.05. 2003, while I was on bail, I assaulted her by grabbing her around the throat, kicking her in the leg and pushing her in the chest area several times. That is also untrue. That is why I called for CCTV which we have at the common door to show whether what Simone da Souza, the prosecution and the doctor are alleging is true. This is what happened: I have never harassed my ex-girlfriend since she chose to live under my nose with another man. We lived opposite each other and we met on the corridor several times. Then came the bill from BT (nearly £200). I noticed that my ex-girlfriend has been calling home directly even I used to buy phone cards for that purpose and she has been on chat line with other men. I called BT who confirmed that someone in my flat has been on chat line. THAT WAS ABUSE OF MY PHONE AND I FOUND IT IMMORAL AND UNACCEPTABLE. Both at the nearby Internet café and at the communal door, I showed her the bill and asked her to pay her due. I FELT SO EXPLOITED BY SOMEONE I TRUSTED.

In her response, my ex-girlfriend called me a poor man who was clinging to a £100. I said it is a matter of responsibility. I asked her. After all, this poor man put you up when you had nowhere to go and you paid nothing. But I did not know you were exploiting me behind my back. That is what hurt. But if you want to get away with it because of the police warning, so be it. I will pay myself.

At that point Simone da Souza alias Tania called the police. I was arrested and charged with threat to kill, intimidation to witness, breach of bail, common assault and kept in custody in Brixton prison, a couple of miles from where I live for two months. ALL THIS BECAUSE TANIA TOLD THE POLICE THAT I SAID POLICE CAME TO MY PLACE FIVE TIMES AND DID NOTHING. That is a lie. Police never came to my place five times and I never boasted of not being arrested. That exaggeration convinced the police to have me jailed but then some charges had to be invented so as to give it a strong credibility.

The judge said the charges were too serious that my case had to be sent to Crown Court. After sometimes in prison, while in court I asked for bail, because if I was detained there for breach of bail, then I had served it. A LADY from the prosecution intervened saying that I was kept in jail because of the serious charge of threatening to kill someone. But then by that time - in the absence of any evidence – my case was not sent to Crown Court, so the charges were dropped then. So why was I kept in custody for one full month after all the above named charges were dropped or were not pursued as the solicitor put it if there was no evidence? Why did my then solicitor not do anything about it?

If the court refused me bail because I would commit further offence, why was I released again on bail on 17 July 2003, two days after my custody time limit had expired? The judge said an error had been committed and my custody time limit was not renewed according to the law. If you hold a criminal whom you believe is charged with serious offence such as “threatening to kill someone”, you would not be reckless as not to renew his or her custody time limit. When the judge pronounced my release on bail (but while in prison I was refused bail three times), my barrister was not even in the room. She was only informed later.

12. While in jail, I was assaulted by a cellmate at night and threatened to be killed by another during the day. I reported to the Senior Officer who asked me if I wanted a police investigation. I said I would consult my solicitor first. I wrote to my then solicitor and he never replied. I was subsequently removed from A Wing to B Wing. Drugs, mobile phones all get in there. You wonder how! I was locked up in a cell with a rapist and I protested until I was changed cell. I also refused to be locked up in a cell with a guy from Burundi, Burundi being one of the aggressors of my country, the Democratic Republic of Congo, together with Rwanda and Uganda, who in turn are sponsored by Britain and America. I was once visited by a “Ugandan Prison Officer”. My visits were restricted. A friend who came to visit me once was told that I was already a convicted prisoner – said one file. Another file said I was on remand. One officer told me that he has a friend from this country who is operating in Angola and Congo as mercenary. He comes back may be twice a year to see his family and he is very rich. He said I was much safer where I was (in prison) then out there.

I used to organise political rallies during breaks, so much so that I was nicknamed MalcomX. I continued with my Congo Campaign through writing to Parliamentarians, the case made so accute by the fact that Prime Minister Tony Blair was then grilled by a Parliamentary Commission for taking Britain to war in Irak, albeit illegally ( I had access to TV and radio). I left some writings on my prison cell that history will never forgive Tony Blair for sponsoring the war in Congo.

13. Mark Ellis is part of a gang in Brixton Hill. I have two proofs for that:

(a) In fact, just as I was released from prison on bail (17.07.2003) - and still live in the same flat next door to my ex-girlfriend. It is funny isn’t it? - once my Jamaican neighbour (the one who threatened me together with Mark Ellis. He lives at 109 Dumbarton Court, Mark Ellis lives at 118 Dumbarton Court together with Simone da Souza and my ex-girlfriend) told me on the corridor: “Oh, we did not expect you out so soon!”. I ignored him. I wrote to Robert Rye of Mackesys my then solicitor. He advised me to seek an injunction against him. Nonsense! Can this man who live just opposite me be moved away with his whole family? I doubt it. What is more curious is that there was a pre-trial review on 18.08.2003 during which I was not produced. My solicitor told me it was not necessary. But the other protagonists were produced because Tania da Souza who lives with my ex-girlfriend served Mackesys, my solicitors with a statement.

(b) Mark Ellis is employed as a cleaner by the Indian man who own Bombay Inn restaurant in Brixton Hill. On 12.10.2003, at 1:15 pm, I was walking back home from Brixton Market where I went to do some shopping when, the Indian man saw me and stopped his car, just by Olive Morris House and in front of a big CCTV. He shouted the following words to me: “Hey jail bird, so you miss your girl friend eh! So he is taken away from you eh”. I simply said: “Well, I also know someone who took your property from you in Uganda and that is Idi Amin.” And I walked past behind his car. First of all he put his car in reverse gear and drove back as to run over me. I jumped forward. I said what are you doing this for? Are you mad? He came out of his car and physically assaulted me. He punched me on the head and shoulders but I kept on dodging his punch. I did not want to fight him, especially in public. The traffic behind him came to a stand still.

When I said, I am going to call the police right now, he opened his car door on the right, took out what looked like a hand gun and chased me into the main road, threatening to hurt me. If the traffic came opposite me, I could have been run over. I walked back to the driver behind him and asked him if he has seen all that was happening and he was willing to be a witness. He told me to write down his car plate number. It is a Volvo N 621 UMD. I called in to the Brixton Police station and reported the incident to an officer (LX 964). I gave my contact details to the police who promised that an investigation would be carried out under the “Beat Crimes at Brixton” Operation (by PC Carlton?) and a crime reference LK 1243967/03 was issued. Does all this tell you that it me who is the victim of crime and not the other way round?

The other guy opposite me in Dumbarton Court, N0 109, was arrested on 29.04.2005, allegedly for drug trafficking and breaking in the block we live in by forcing the door and damaging it. He was held in a cell in Brixton Police Station and questioned by the police, and released at 4am in the morning.

14. In fact the Lambeth Council Housing has understood that my life is in danger and they are planning to transfer me (see letter attached).

15. There is a background to this case. When I moved into the Council studio flat I occupy now as a tenant, I did not know, it was previously occupied by a Caribbean man whom the council kicked out for letting prostitutes use it for “business”. Obviously, the Council did not tell me, the police told me when they first came to my flat. Could this whole problem with my Jamaican neighbours be a backlash?

I also had problem with my neighbour and compatriot, Masha who lives at 79 Dumbarton Court (Masha is not her real name. She told me she gave it to the Home Office when asking for asylum. Rita Lukusa is her real name). "She is a mother of two but hides the fact to her clientèle (men) because she is a prostitute," another Congolese neighbour who knows her well told me, adding that, "she parted company with the father of her children when he was suspected of sleeping with white men homosexuals and therefore starving her sexually." I used to welcome her as a compatriot. She would come to eat and have drinks regularly at my place but I did not know she had own problems. Her brother was in jail for using false credit cards to draw money from several banks and I literally saw Masha flanking cars from the kerb of our street (but that her life and her choice) . We were not in a relationship. I only wanted her to be aware of what is going on in our country back home.

But one day, she told me that she was with a Jamaican guy, that Caribbean guys handle women better than Africans men who want very much to be in control (curiously, my ex-girlfriend told me the same thing when I asked her why she did what she did). I told her if she were pregnant, usually, Caribbean men would live her alone to raise a child on her own, which would be difficult while on benefit. She stormed out in anger and called the police, she told them that I had raped her! THAT IS WHAT YOU CALL CHARACTER ASSASSINATION! I was questioned by the police all night long. The police later released me and apologised to me. They said she lied and asked me to keep away from her. Now, after my ex-girlfriend left my flat, I would always see her, Masha and Tania together. I don’t know what Masha might have told her about me. Masha is always spotted in the evenings in our local area looking for clients as a prostitute. I did not know her, I welcomed her as a compatriot and possibly involve her in the campaign against the war in our country. I even bought her some jewellery stuff she asked me to when I went to Brussels, but she did not have enough money to reimburse me. I gave them to my ex-girlfriends. When she left she left them. But I paid a heavy a price for my hospitality both to "Masha" and Selma Iyambo.

16. I have now lost my job with New African Magazine. My boss, Afif Ben Yedder, told me right when I was in prison that my services would not be needed anymore. Cruel, isn’t it? At least he could have waited until I was out. It made me think a lot . I was convinced that there was a plot against me, including from where I worked. And now I have to face the bills from the Inland Revenue, TV licence, council tax, rent arrears, BT phone bill… which I can’t pay if I am not compensated some money for the time I spent in jail, obviously not working.

Mr George Van Dunnen, my witness badly let me down. I called him on the number he gave me to ask why he did not turn up in court but the line was disconnected. I also wrote to him on the 19 September 2003 but there was no reply. Mr George Van Dunnen never turned up in court. His version of events is that the police bribbed my ex-girlfriend to punish me for my political campaign against British interests in Congo. He had infiltrated my ex-girlfrind's camp, he said.

CONCLUSION:

I am an honest and law-abiding person. I mind my dignity, honour and reputation and the last thing I would like to have in my life is a criminal record. I have never committed a crime in my life – but I have been a victim of crime several times – and I have never been in jail in my life until this incident. I feel very traumatised about it. But this a different country with different laws where my African world-view (helping others, community, togetherness in happiness and in trials) is naivety. I HAVE LEARNT MY LESSON, ALBEIT THE HARD WAY. MY EX-GIRLFRIEND IS NOT WORTH ANY GRIEF TO BE HONEST. ALL I WANTED IS TO HELP HER. THE LAST THING I WOULD HAVE DONE WAS TO HURT HER.

PROOF?

This is a letter she wrote home shortly before the first time the police came in, telling her family that she was OK, everything was OK, but she did not even mention me in the letter and it was not dated. I found it in one of my floppy disks on my desk shortly after being released.

If everything was ok, shortly before the first time the police came in, then she was certainly used by a hidden hand!

I hope this letter finds everyone in good health, I apologize for taking so long to write, but I hope Imm’s got internet connections, so I could get in touch more often. I’ m doing fine, pls don’t worry about me and I’m not sure if I’ll be able to visit in March, I have so much going on, my job is great and I have started a course on Business Accounting, I had accommodation problem which was really getting to me. The weather is as usual, it snowed just a few days and yesterday too, but it’s not so cold now, it’s only windy. I’m sending a few things with Una, hoping that it won’t be lost on the way. I can’t send any pic’s either, I’ve been pre-occupied lately, that I didn’t get a chance to take any.

Mom, I hope you feeling a lot better now and hopefully back to work, that’s if you still want to go work anyway, What’s Ruben up to this year? Did he pass his exam’s? Is he going to university, or anything, just wondering really, just a bit worried, I’ll call anyway, probably before this letter finds you.

Hoping you had a good festive season and I miss you guys so much, it’s gets lonely sometimes, or I just miss home really, I miss chatting to you guys, it’s not the same on the phone, you always seems so serious, sometimes I feel you like you not happy to hear from me, do you really miss me? I hope you do, anyway it makes me feel better that way. How’s sis and the kids, hoping their doing fine, hoping she’s doing fine and business wise. It’s hard to decide what to send you guys since my budget is limited, I’ll just pick up a few things there and there. It’s late at night and I just came back from work, need my beauty sleep, bey for now.

Le fait que Ruberwa, un Rwandais nous imposé par les Américains et maintenant devenu vice-président au Congo (sans oublier que d'autres criminels à la personne de Bemba et de Zahidi Ngoma sont aussi vice-présidents de transition) touchant un salaire de $350,000 par mois comme J.S. le dit, est un acte d'usurpation et de fraude, mais le peuple Congolais qui ne l'ignore pas, va prochainement se prononcer à l'issue des élections libres et transparentes.


2. Ceci est ma dernière contribution dans cette discussion, dès maintenant chaque mail qui vient de la personne en question sera renvoyé - sans être lu - dans la poubelle.
Et j’appelle tous les autres camarades à faire la même chose.
Laissons un peu la silence à la personne en question (Lokongo), pour qu’il a le temps de réfléchir, c’est la seule chance qu’il a de retrouver la raison.
Ou peut-être, un jour, il aura le courage de reconnaître les bêtises qu’il a fait [contre les Tutsi] et dit et il retrouvera le chemin vers le combat “nationaliste”, franchement après le courrier des derniers mois cela me paraît plus probable, mais j’espère que je me trompe.

REPONSE: Ecoutez-moi ce pauvre belge! La Belgique n'est rien sans le Congo, il ne l'ignore pas. Si moi je dois vivre dans la misère parce que «Ne Jamais Trahir» c'est notre ligne de conduite, lui, en tant que lobbyist des Tutsi en Belgique, devient de plus en plus une grosse légume avec l'argent de sang que les Tutsi, tueurs des Congolais lui font bourrer et son parti se construit des chateaux avec l'argent du Congo.

Il fait le lobbying non seulement pour les Tutsi mais aussi pour les Mobustistes (peau d'agneau, coeur du loup). C'est exactement en ces mêmes termes qu'un grand Mobutiste m'a ménacé à Londres à l'hotel(je suis venu rencontré un confrère journaliste venu de Kinshasa) lors du dernier passage de Joseph Kabila à Londres: «Lokongo, tu es encore vivant?!», s'est-il étonné (B. Bodack). Donc, il s'attendait que je sois déjà «écrasé». Ce qui est certain c'est que James Kabarebe au Rwanda a fait enrôler de force les jeunes Banyamulenge et les expédie à Gabiro pour un entraînement de courte durée pour servir de contingents de soutien armé pour ses objectifs en R.D.C. Il fait assassiner les tutsis banyamulenge (Gatumba,…) afin de donner un alibi au désordre qu’il suscite sous prétexte de libérer une communauté opprimée pour laquelle il concocte une autre organisation»

Moi Lokongo, J'accuse officiellement Tony Busselen alias Léonard Kasimba et le Tutsi Munyamulenge Benjamin Munyanyira d'avoir été parti pri de ce Shenanigan de Katumba de comminvence avec James Kabarebe. Ils ont été les premiers à accuser les Congolais d'avoir perpetré ce massacre. Peu apres HRW et d'autres organisations de droits de l'homme leur ont prouvé le contraire.

Nous leur avons dit: Voilà maintenant Tony et Benjamin. Vous avez accusé les Congolais. Et maintenant que dites-vous? Tous les Tutsi au Congo ont le même agenda caché (...) avec les Tutsi au Rwanda. Il n'y a point de doute. Ils ne cherchent que le soutien des occidentaux, le parti de Tony entre autres(ils l'ont déjà) pour realiser ce projet macabre contre la RDC. Il ne serait pas étonnant si nous apprenosn que ces deux messieurs ont rencontré et Kagame, et Ruberwa lors de leurs derniers passages à Bruxelles. Les Anglais en ont un mot:«Double Agent». Qu’on nous le dise!

Je me demande si Léonard Kasimba n'est pas derrière tous les troubles que j'ai endurés à Londres:
